End User Licence Agreement (EULA)
 

This End User Licence Agreement (“Agreement”) is a legal agreement between you (“you,” “your,” or “User”) and COVENANT ADVISORY CIC, also known as DiscoverTMJ.com / TheMannaJourney.com, a community interest company registered in England and Wales with its registered office at 20 Broadfields Avenue, Edgware, HA8 8PG, and D-U-N-S® Number 225846532 (“we,” “us,” or “our”).
 

This Agreement governs your use of the TMJ mobile application, and any related services, content, websites (including DiscoverTMJ.com and TheMannaJourney.com), and features provided by us (collectively, the “Service”).

By downloading, installing, accessing, or using any part of the Service, you confirm that you have read, understood, and agree to be bound by this Agreement. If you do not agree, you must not use the Service.

 

1. Definitions

App means the TMJ mobile application available for iOS and Android platforms.
Content means videos, text, images, audio, graphics, and other media made available via the Service.
User means any individual who downloads or uses the Service.
Device means a smartphone, tablet, or other compatible hardware on which the App is installed.

 

2. Licence Grant

Subject to your compliance with this Agreement and our Terms of Use, we grant you a limited, non-exclusive, non-transferable, revocable licence to:

  • Download, install, and use the App on a Device that you own or control;
     

  • Access and stream Content for personal, non-commercial, lawful purposes only.
     

This licence does not transfer ownership or grant any rights beyond what is expressly stated.

 

3. Licence Restrictions

You must not:

  • Copy, reproduce, distribute, or publicly display the App or Content;
     

  • Modify, reverse engineer, decompile, or attempt to extract source code;
     

  • Sell, rent, or exploit the App or Service for commercial purposes;
     

  • Interfere with security, digital rights management, or content protection systems;
     

  • Use the App in violation of applicable laws, third-party rights, or our Terms of Use.
     

 

4. Ownership

All intellectual property rights in the App, Content, and Service are owned by or licensed to COVENANT ADVISORY CIC. No rights are transferred to you by this Agreement.

 

5. Updates and Maintenance

We may update the App to fix bugs, enhance functionality, or meet legal requirements. You agree to receive these updates automatically via your app store. We are not obligated to support or maintain specific features or Content.

 

6. Third-Party Services

The App may include links or integrations with third-party services (e.g., analytics tools, embedded players). We are not responsible for their content or practices. Your use of such services is governed by their respective terms and policies.

 

7. Termination

This licence remains effective until terminated. It will terminate automatically if:

  • You violate any terms of this Agreement;
     

  • You uninstall the App;
     

  • We revoke your access at our discretion.
     

Upon termination, you must cease all use of the App and delete it from your Devices.

 

8. Data Protection and Privacy

Use of the App is also subject to our Privacy Policy, which outlines how we handle your personal data in accordance with the UK GDPR and Data Protection Act 2018.

 

9. Disclaimers

The App and Service are provided “as is” and “as available.” We do not guarantee:

  • Uninterrupted or error-free operation;
     

  • That Content will be complete or up to date;
     

  • That the App will be compatible with all devices or systems.
     

 

10. Limitation of Liability

To the extent permitted by law, we are not liable for:

  • Indirect or consequential damages;
     

  • Loss of data, revenue, or business;
     

  • Bugs, service disruptions, or failures.
     

Your sole remedy is to discontinue use and uninstall the App.

 

11. Governing Law and Jurisdiction

This Agreement is governed by the laws of England and Wales. Disputes shall be subject to the exclusive jurisdiction of the English courts unless you are a resident of Scotland or Northern Ireland, in which case local laws and courts apply.

 

12. Apple and Google Third-Party Terms

If you download the App via Apple or Google:

  • This Agreement is between you and COVENANT ADVISORY CIC, not Apple Inc. or Google LLC;
     

  • Apple and Google are not responsible for the App’s maintenance or legal compliance;
     

  • You must comply with all applicable App Store or Play Store terms.
